Ontario First-Time Home Buyer Rebates and Incentives
Navigating Your First Home Purchase in Ontario
Purchasing your first home is a significant milestone. For buyers in Ontario, it's important to understand the taxes involved in the transaction, as well as the provincial programs designed to provide financial relief. This guide outlines key rebates and incentives available to first-time homebuyers, based on information from the Government of Ontario. It covers the Land Transfer Tax (LTT) refund and the Harmonized Sales Tax (HST) rebate for new homes.
Understanding Ontario's Land Transfer Tax (LTT)
When you buy land or an interest in land in Ontario, you are required to pay the provincial Land Transfer Tax (LTT) (Source: ontario.ca LTT). The term "land" is broad and includes any buildings on the property, buildings that are to be constructed, and fixtures like light fixtures and built-in appliances (Source: ontario.ca LTT). The LTT is typically calculated based on the amount you paid for the property, which includes any mortgage or debt you assume as part of the purchase (Source: ontario.ca LTT). The tax is payable when the transfer of ownership is registered (Source: ontario.ca LTT). It is also important to note that if you buy a property in the City of Toronto, you may also have to pay a separate municipal land transfer tax (Source: ontario.ca LTT).
The Land Transfer Tax Refund for First-Time Homebuyers
To assist first-time homebuyers, the province offers a refund on all or part of the LTT (Source: ontario.ca LTT). For property transfers that occurred on or after January 1, 2017, the maximum refund amount is $4,000 (Source: ontario.ca LTT Refund). This increase applies regardless of when the agreement of purchase and sale was signed (Source: ontario.ca LTT Refund). In practical terms, this means qualifying first-time purchasers pay no land transfer tax on the first $368,000 of their home's value (Source: ontario.ca LTT Refund). For homes with a value greater than $368,000, eligible buyers can receive the maximum refund of $4,000 (Source: ontario.ca LTT Refund). This refund is available for both newly constructed and resale homes, as long as the agreement of purchase and sale was entered into after December 13, 2007 (Source: ontario.ca LTT Refund).
Who Qualifies as a First-Time Homebuyer?
The provincial criteria for the LTT refund are specific and must be met in full. To be eligible, you must satisfy the following conditions:
- You must be at least 18 years of age (Source: ontario.ca LTT Refund).
- You cannot have ever owned a home or an interest in a home, anywhere in the world. The method of previous acquisition, whether by purchase, gift, or inheritance, is not relevant (Source: ontario.ca LTT Refund).
- Your spouse cannot have owned a home or an interest in a home anywhere in the world while he or she was your spouse (Source: ontario.ca LTT Refund).
Once you have owned a home, you cannot re-qualify for this refund in the future (Source: ontario.ca LTT Refund). It is important to be aware that these provincial rules may be different from those for federal programs, such as the Canada Revenue Agency Home Buyers' Plan (Source: ontario.ca LTT Refund).
What if I'm Buying with Someone Else?
The refund amount can be affected if you are purchasing a home with other people who are not first-time homebuyers. The refund is limited to the proportionate interest acquired by the individuals who qualify for the refund (Source: ontario.ca LTT Refund).
For example, if a parent who is not a first-time homebuyer and a child who is a first-time homebuyer purchase a home with equal 50/50 interests, the child can claim a refund of 50% of the land transfer tax refund. The child's claim cannot be more than 50% of the maximum allowable refund of $4,000 for conveyances on or after January 1, 2017 (Source: ontario.ca LTT Refund).
There is an exception if a non-qualifying individual, like a parent, is on title for financing purposes only. If the parent did not acquire a beneficial interest in the property, the child may still qualify for the full refund. This requires submitting evidence, such as a letter from the bank confirming the parent is on title for the mortgage or a copy of a trust agreement (Source: ontario.ca LTT Refund).
In a scenario with a spouse who previously owned a home, a qualifying purchaser may still be able to claim a refund in proportion to their spouse's interest, provided the spouse owned that home before becoming the purchaser's spouse (Source: ontario.ca LTT Refund).
How to Claim the LTT Refund
Qualifying taxpayers can claim an immediate refund at the time of registration. If registering electronically, this is done by completing the required statements in the electronic land transfer tax affidavit (Source: ontario.ca LTT Refund). If the refund is not claimed at registration, the full LTT must be paid. Afterward, you can submit a claim for the refund directly to the Ministry of Finance, though no interest is paid on this type of refund (Source: ontario.ca LTT Refund). You can also apply online for the refund through the Ministry of Finance's online services portal (Source: ontario.ca LTT Refund).
Another Rebate: HST on New Homes
The Harmonized Sales Tax (HST) is another cost to consider, but it only applies to newly constructed or substantially renovated homes, not to resale homes (Source: ontario.ca LTT). If you are buying a new home, you may be eligible for a rebate of the provincial portion of the HST. This rebate can be up to $24,000 of the provincial portion (8 per cent) of the HST (Source: ontario.ca LTT). For any questions regarding the HST new housing rebate, you should contact the Canada Revenue Agency at 1-800-959-5525 (Source: ontario.ca LTT).
