What Is a POTL Fee on a Freehold Townhouse in Ontario?
The question: this came up in a r/TorontoRealEstate thread about a pre-construction freehold townhouse in Aurora with a monthly POTL fee. I have answered it for York Region buyers and renters, with sources below.
Short answer: POTL stands for parcel of tied land. You own your townhouse and its lot as freehold, but that parcel is legally tied to a share of a common elements condominium corporation that owns shared items such as a private road, visitor parking, mailboxes or landscaped areas. The monthly POTL fee pays for those shared items. It is usually far lower than a regular condo fee, but it is not optional, and the corporation has rules and a budget like any condominium.
How it differs from a regular condo townhouse
- Ownership: with POTL you own the house and land; in a standard condo townhouse you own a unit and the corporation owns the structure and land.
- What the fee covers: POTL fees cover the common elements only. Your roof, windows, driveway and insurance on the house are usually your responsibility.
- Governance: common elements condominiums are created under Ontario's Condominium Act, 1998, so there is a board, a declaration, by-laws, rules and a reserve fund.
What to check before you buy
- The status certificate (resale) or disclosure statement (new build): budget, reserve fund, any special assessments and lawsuits. My Condo status certificate checklist explains what to read.
- The fee after any builder holiday: a builder may waive fees for a period. Ask what the fee becomes afterwards and what the budget assumes.
- What exactly is common: a private road is costly to repave and plough. Know what the corporation maintains.
- Rules: some corporations restrict exterior changes, parking or rentals.
The Condominium Authority of Ontario offers guides on owner rights and disputes for condominium owners, including common elements corporations.
Is a POTL townhouse a bad idea?
Not automatically. It can be a good middle ground between a condo and a fully freehold house. Compare the full monthly cost (mortgage, property tax, POTL fee, insurance and a maintenance reserve) with similar homes that have no fee, and have your lawyer review the documents before your offer is firm.

FAQ
What does POTL mean in real estate?
Parcel of tied land: a freehold property that is tied to a share in a common elements condominium corporation, which owns shared items such as a private road.
Is a POTL fee the same as a condo fee?
It works the same way but usually covers far less, only the shared common elements, so it is typically much lower. It is mandatory.
Does a POTL townhouse have a status certificate?
Yes. A common elements condominium corporation can provide a status certificate, and your lawyer should review it before you firm up.
